Freedom of Information Act

FOIA Details

When submitting a FOIA request, the following information must be included:

  • Complete name
  • Address – Must be written in compliance with United States Postal Service addressing standards.
  • Contact information – Must include a valid telephone number or electronic mail address.
  • Description of the public record(s) requested.

Under the Michigan Freedom of Information Act (FOIA), the timeline to respond to a request depends on how it is delivered:

  • U.S. Mail or in-person delivery: The receipt date is the day the public body receives the written request.
  • Email, Fax, or Electronic Form: The receipt date is one business day after the electronic transmission is made.

The public body then has 5 business days after the receipt date to issue an initial response (granting, denying, partially granting/denying, or taking a 10-business-day extension).

"Business days" are defined as Monday through Friday, excluding weekends and official state and federal holidays. These holidays are excluded from the statutory deadlines for processing public record requests.

The District may charge fees to search, examine, review and redact exempt information for public records. If fees are estimated to exceed $50, a good-faith estimate will be provided to the requester and a 50% deposit will be required prior to fulfillment of the request.  The deposit must be paid within 45 days of receiving the estimate, or the request is considered abandoned.

Regarding fulfilling granted or partially granted FOIA requests, FOIA does not contain any express provisions that provides a timeframe for fulfillment.

What is FOIA? 

From FOIA.gov: Since 1967, the Freedom of Information Act (FOIA) has provided the public the right to request access to records from any federal agency. It is often described as the law that keeps citizens in the know about their government. Federal agencies are required to disclose any information requested under the FOIA unless it falls under one of nine exemptions which protect interests such as personal privacy, national security, and law enforcement.
